Full text of BEC rulings

Last night, the Board of Elections Commissioners ruled on five out of nine complaints from Missouri Students Association presidential and vice-presidential candidates, including the Jordan Paul/Colleen Hoffmann slate and the Phyllis Williams/Jonathan Snipes slate. No complaints have been filed by or against Joe Fessehaye and Lindsey Abell. The full text of the rulings is below.

STATUS OF COMPLAINTS:

Complaint 1 from Williams-Snipes, Posting in Windows and Bathroom Areas-

This was due to a misunderstanding and no fines will be levied.

Complaint 2 from Williams-Snipes, Excessive Fliering in A&S and Middlebush-

Alleges that excessive flyering occurred in Middlebush and A&S.  My last conversation with Phyllis led me to believe that this was the same complaint as the above complaint.  If it's not, we'd like to clarify: "excessive fliering" is not an infraction in the handbook, nor have we seen any evidence that the "excessive fliering" occurred outside bounds permitted by building managers.  Therefore, there will be no fines levied.

Complaint 3 from Williams-Snipes, Excessive Fliering in Engineering Building West-

Same as the above mention complaint.

Complaint 4 from Williams-Snipes, "Soliciting" in Off Campus Apartments-

Alleges that door hangars were put on the doors of 4 off campus apartment facilities and this is soliciting.  Three witnesses have confirmed the allegations.  However, we don't have any jurisdiction as these are not ResLife-sponsored housing facilities.  Therefore, we will not levy any fines.

Complaint A from Paul-Hoffman, Flyer on Wall Next to Bulleting Board in A&S-

Alleges there is a flier next to a bulleting board on the second floor of A&S, and that this is a violation of rules regarding posting beside bulletin boards as well as a violation because the Williams-Snipes slate has not yet produced Form 10 to be able to post this flier.

FURTHER INVESTIGATION WILL BE REQUIRED TO DETERMINE THE LEGITIMACY OF THE FIRST ALLEGATION.

However, we believe that at best the second allegation implies that we should monitor further Form 10s from the Williams-Snipes slate for a possible late forms infraction (once the Form 10 is 14+ days overdue) and does not warrant an immediate fine.

Complaint B and C from Paul-Hoffman, Flyers Posted w/o Form 10-

Alleging that fliers were posted in areas that require prior building manager approval without the Williams-Snipes slate having/producing such approval.  No Form 10s have been filed with these approvals for the Williams-Snipes slate.  However, we believe that at best these allegations imply that we should monitor further Form 10s from the Williams-Snipes slate for a possible late forms infraction (once the Form 10 is 14+ days overdue) and does not warrant an immediate fine.

Complaint D from Paul-Hoffman, Flyer Posted on Maneater Receptacle-

Alleges a flier posted on a Maneater receptacle in A&S with photo evidence to verify.  However, the Maneater receptacles are not covered in the handbook, the Maneater regulations have no power in the handbook, and there are no Forms dealing with Maneater permissions.  No fines will be levied, but all slates will be receiving an e-mail forwarded from the Maneater's editor-in-chief enumerating their wishes on the subject.
