The assault trial of an MU fraternity member was set Monday after being delayed three times.
Junior Jeffrey Forkan, a Kappa Alpha Order fraternity member, will stand trial on Feb. 28 on charges of third-degree physical assault.
Police investigated Forkan after Daniel Maddox, a Maryland resident, alleged he was beaten outside the Kappa Alpha Order house while visiting Columbia.
Maddox claimed six members of the fraternity attacked him at 3 a.m. on Oct. 15, 2005, outside the fraternity's house, located at 1301 University Ave.
In a previous interview with The Maneater, Maddox also said the fraternity members repeatedly called him "faggot" and "pretty boy" during the attack and an unidentified assailant later attacked him in the driveway of another house.
Maddox said he suffered injuries to his left eye, a scar from his left temple to his left eye and a concussion from the altercation.
Some fraternity members, including chapter President Chip Wagner, in previous interviews said Maddox entered their house drunk and had to be forcibly removed.
They said Maddox started the altercation by punching Forkan while he was being removed from the house. They alleged Maddox called them "faggots" as well.
Forkan's attorney declined to comment on the case and the prosecuting attorney assigned to the case was not available for comment.
